Terms of Service (Public Offer)

This document is a public offer from SOFTITURA LLC (hereinafter — “Service”, “We”) to any individual (hereinafter — “User”, “You”) to use the Vitra web application available at vitra.fit and related subdomains.

1. Subject

1.1. The Service provides Users with access to a SaaS platform for tracking nutrition, generating meal plans and AI-based recommendations through the vitra.fit website.

1.2. Acceptance of this offer takes place by creating an account, signing in via OAuth, or starting to use any paid or free feature of the Service.

2. Account and access

2.1. You must be at least 16 years old to use the Service. By accepting these Terms you confirm that you meet this requirement.

2.2. You are responsible for the confidentiality of your account credentials and for all actions performed under your account.

2.3. We may suspend or terminate access without prior notice in case of violation of these Terms, fraud, abuse, or risk to other Users.

3. Subscriptions and payments

3.1. The Service is offered under a freemium model with optional paid subscriptions (monthly, 6-month and annual plans). Prices, features and limits of each plan are published on the pricing page and may be updated.

3.2. A free 7-day trial may be offered for new accounts. Limits apply (number of scans, AI plans, etc.).

3.3. Subscriptions auto-renew until cancelled. You can cancel anytime in your account before the next billing date.

3.4. Payments are processed by a third-party payment provider. We do not store your full card data on our servers.

4. Acceptable use

4.1. You agree not to: (a) reverse-engineer or scrape the Service; (b) upload illegal, harmful, infringing or deceptive content; (c) use the Service to provide medical, dietary or therapeutic advice to third parties; (d) attempt to bypass authentication, rate limits or RLS policies.

5. AI features and disclaimer

5.1. Calorie estimates, macro breakdowns, meal plans and recommendations are produced by AI models and are not medical advice. Always consult a qualified physician or registered dietitian before changing your diet, especially if you have medical conditions, allergies, are pregnant, breastfeeding, or under 18.

5.2. AI output may contain errors. The Service is provided “as is” without warranties of accuracy, fitness for a particular purpose or non-infringement.

6. Intellectual property

6.1. The Vitra brand, design, source code, content and trademarks belong to SOFTITURA LLC and are protected by applicable IP law. You receive a limited, non-exclusive, revocable, non-transferable licence to use the Service.

6.2. You retain ownership of the content you upload (photos, notes). You grant us a worldwide, royalty-free licence to process this content solely for the purpose of providing the Service.

7. Liability

7.1. To the maximum extent permitted by law, the Service's aggregate liability is limited to the amount you actually paid for the subscription during the last 12 months.

7.2. We are not liable for indirect, incidental, consequential damages, loss of profits or data.

8. Termination

8.1. You may close your account at any time from the Settings page. Stored personal data is deleted within 30 days, except where retention is required by law.

9. Changes

9.1. We may update these Terms. The “Last updated” date above reflects the current version. Continued use after changes constitutes acceptance.
